I um... have a question. When is it okay to have a Pokemon's defense equal?

So, if you remember, my first answer was an Empoleon set that had an illegal EV spread. Then somepoint later, I edited the moveset to change the move Waterfall to Scald, and I did a weird EV spread on my Empoleon set: 252 HP / 132 Def / 124 SpD with a Bold Nature, causing both defense stats to equal 269. When are those spreads okay?
